Application for Investment Certificate
(Setting up FDI project with invested capital up to VND 300 billion and not belong to conditional sectors of investment, not associated with establishment of enterprise/branch)

Procedure:
|
|
- Investor submits application to the “one-door” office of the Department of Planning and Investment.
- If the application is adequate and valid, the reception officer will accept and issue receipt.
- Investor receives investment certificate at the “one-door” office of the Department of Planning and Investment.

|
Mode of execution:
|
|
Procedure to be done directly at the office of an administrative agency.
|
|
Documents required:
|
|
* Dossiers of application include:
1- Written request for issuance of investment certificate (follow stipulated form).
2- Business cooperation contract in case of the mode of investment follows a business cooperation contract.
3- Valid copies of identity card/ passport/ or other legal personal identities; copies of decision on establishment/ business registration certificate/ or other equivalent documents of the company.
4- Letter of attorney attached with a copy of identity card/ passport/ or other legal personal identities of the company representative.
5- Report on financial capability of the investor (to be prepared and liable for by the investor).
* Number of application set required: 03 sets.

Duration of the procedure:

|
15 working days, since the date of receiving application.
|
|
Subjects of the procedure:
|
|
Foreign investors in name of organizations or individuals, and/or Vietnamese organizations or individuals intend to cooperate with foreign investors.
|
|
Agencies to execute the procedure:
|
|
- Agency to issue investment certificate: City People’s Committee.
- Agency to execute the procedure: Department of Planning and Investment.
|
|
Result of the procedure:
|
|
Investment certificate.
|

Fee:
|
|
Free of charge.

Forms to be used:

|
Request for issuance of investment certificate (follow the stipulated form in the Decision No.1088/2006/QĐ-BKH).

Requirements of the procedure:
|
|
- Setting up FDI project not associated with establishment of enterprise/branch.
- Having invested capital from VND 15 billion up to VND 300 billion.
- Not belong to conditional sectors of investment (regulated at Article 29, Law on Investment).
- Not belong to sectors of investment as regulated at Item 1 Article 37, Decree No.108/2006/NĐ-CP.
